Terms of Service | Hillduck

1. The service

I build and configure a lead response system for your agency. Once it is running, every submission to your website form receives a reply by email and text message within sixty seconds, the person responsible for new business is notified with the details the lead provided, and both the time of arrival and the time of response are recorded. A summary of those response times is provided each month. The build ordinarily takes about two days.

2. Your responsibilities

You will provide access to the form and to the accounts in which the system runs, a reply template approved by you, and the name and contact details of the person to whom leads are directed. You confirm that you are entitled to send an email and a text message to a person who submits your own form. Third party services used by the system are held in your name and billed to you directly, with no markup by me.

3. Fees

Fees are agreed in writing before any work begins. No amount is payable that was not agreed in advance.

4. Acceptance

The completed system is tested against your own form, with you present, before any payment falls due. If it does not do what clause 1 describes, no payment is due.

5. What is not promised

I am responsible for the speed of the first response and I stand behind it. I do not warrant any particular level of enquiries, sales or revenue, all of which depend on your pricing, your coverage and the people making the calls. The system relies on services run by others, including your form, your email provider and your text messaging provider, and I am not responsible for an interruption caused by one of them.

6. Liability

My total liability in connection with this service is limited to the fees you have paid in the twelve months before a claim is made. I am not liable for indirect or consequential loss, including lost profit or lost business.

7. Ending the arrangement

Either of us may end an ongoing support arrangement at any time by written notice. The system stays in your accounts and keeps running, and nothing further is payable.

8. Changes to these terms

These terms may be revised. The version that applies is the one published on this page when the work is agreed.
